General Terms and Conditions (GTC)

1. Scope of Application
These Terms and Conditions govern the rental of parking spaces in the Casino-Palace parking garage in Lucerne.
The GTC are an integral part of the lease agreement. By signing the lease agreement, the tenant confirms that they have read the GTC and agree to their terms.
For the sake of readability, the grammatical masculine form is used in these GTC (e.g., “tenant”). The terms always encompass all genders and gender identities
2. Rental Property and Use
The tenant is granted the right to use a parking space in the parking garage. There is no entitlement to a specific designated space; the tenant may choose any available parking space.
In the event of operational restrictions (e.g., due to events with increased parking reservations at the Grand Casino Luzern and/or the Mandarin Oriental Palace Hotel), access for tenants is guaranteed.
If the sign reads “OCCUPIED,” the long-term tenant is entitled to a parking space in the parking garage.
The lease agreement continues without interruption even during periods of temporary non-use (e.g., due to vacation). It is not possible to deposit the parking card or ticket.
3. Rent, VAT, and Additional Costs
The rental fee is specified in the lease agreement. Changes in the value-added tax rate are automatically adjusted. All ancillary costs are included in the rental fee. Offsetting against counterclaims is excluded.
4. Notice Period
The notice period is 30 days in advance, effective at the end of a month, unless otherwise agreed in the lease agreement.
5. Rent Adjustments
The landlord may adjust the rent effective as of the next contractual notice date. Notice must be given in writing at least 60 days prior to the planned effective date and must include the previous and new rent amounts as well as the effective date.
The tenant may reject the rent adjustment in writing up to 30 days before the effective date. In this case, the lease agreement terminates on that date without the need for a separate notice of termination. The previous rent remains in effect until the termination date. The contractual notice period is 30 days to the end of a month.
If the tenant gives their consent or pays the adjusted rent starting on the effective date, the rent adjustment is deemed accepted. If the tenant continues to use the rental property after the effective date without rejecting the adjustment within the specified time frame, this is deemed consent.
6. Payment Terms
The rent must be paid in advance, no later than 5 days after the start of the rental period, to the following account: Luzerner Kantonalbank, 6002 Lucerne, account CH24 0077 8010 0011 6930 5, in the name of Parkhaus Casino-Palace AG. The parking card number/ticket number must be included in the payment description. If payment is not made via standing order, you must obtain the payment slips yourself (from the accounting department or the parking garage office).
7. Late Payment, Suspension of Ticket and Parking Card
If the rental fee is not received by no later than 5 days after the start of the rental period (the date on the bank statement is decisive), the ticket or parking card will be blocked and will only be reactivated upon cash payment or proof of payment. If the 5th day falls on a Saturday, Sunday, or holiday, the rental fee must be received by the rental company by the last business day preceding those days.
To prevent misuse, the vehicle may be blocked in individual cases. This measure will be applied proportionately.
8. Replacement of the Parking Card/Ticket
In the event of loss or damage to the parking pass or ticket, a flat-rate administrative fee of CHF 200 will be charged in cash; the renter will receive the new parking pass or ticket upon payment.
9. Rules of Conduct and Prohibitions
Cleaning and maintenance work on vehicles is prohibited. Storing car accessories and other items in the parking spaces is not permitted. The renter must follow all verbal and written instructions from management.
10. Liability and Insurance
The renter is liable for any damage caused while using the parking garage.
Vehicles must be locked. Insurance against theft, fire, and other damage is the responsibility of the renter. The lessor disclaims all liability.
11. Subletting, Assignment, Transferability
Subletting or assignment of the lease agreement requires the prior written consent of the lessor. Tickets/parking passes are personal and non-transferable.
12. Final Provisions
The Lessor may amend these Terms and Conditions. However, price adjustments shall be made exclusively in accordance with Section 5 above.
Changes will be communicated to the tenant by email or letter; the amended version may also be published online. The notice will specify the effective date.
In the event of material changes, the tenant may object in writing up to 30 days before the effective date. The contract will then terminate on the next possible contractual termination date; until then, the previous Terms and Conditions shall apply. The notice period is 30 days to the end of a month.
Editorial clarifications, adjustments to comply with mandatory law, and technical provisions that do not adversely affect the tenant take effect upon notification.
Unless an objection is filed in a timely manner and/or the parking space continues to be used, all changes are deemed accepted.
Should individual provisions of the Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
13. Jurisdiction and Governing Law
The exclusive place of jurisdiction is Lucerne City. Swiss law applies exclusively.
Rental Options and Usage Windows
The contractually agreed rental option and the rental fee are set forth in the lease agreement. Typical usage windows according to the offer options:
a) Early Bird: Monday–Friday 6:00 a.m.–6:00 p.m. Any time exceeding 6:00 p.m. must be paid for at the parking garage cashier’s desk.
b) Early Bird PLUS: Monday–Friday 6:00 a.m.–8:00 p.m.; any time exceeding 8:00 p.m. must be paid for at the parking garage cashier’s desk. Saturday 6:00 a.m.–6:00 p.m.; any time exceeding 6:00 p.m. must be paid for at the parking garage cashier’s desk.
c) Daily Rate: Monday–Friday 6:00 a.m.–8:00 p.m.; Thursday and Friday additionally until 10:00 p.m.; Saturday 6:00 a.m.–6:00 p.m.; Sunday at standard rates. Any time exceeding the allotted period must be paid for at the parking garage cashier’s desk.
d) Long-term renters: Unlimited use 7 days a week.
If published price lists differ from the individually agreed-upon rental rate, the rental rate specified in the lease agreement shall apply.
